Tidal Yoga Terms and Conditions
Our terms and conditions are designed with our students in mind. The priority for Tidal Yoga is that you benefit from your time with us so it is with this in mind that we feel it is beneficial that we understand both our and your responsibilities to one another when you visit the studio and book into one of our classes.
Please read the T’s & C’s so that when you book in with us you agree with our T’s & C’s of business and accept our liability waiver.
1. Updating our Terms & Conditions
We reserve the right to vary or revoke our T’s & C’s from time to time, which we may consider necessary or suitable for the regulation of our Studio and the conduct of our students. Any changes to our T’s & C’s will be published on our website and will apply to all students.
2. Definitions
In these T’s & C’s, the following definitions apply:
Activity and Activities means any services that we offer including a single class session, a course, a teaching programme, retreat, workshop, or other service.
Private Policy means our private policy which may be updated from time to time at our discretion and displayed on our Website and/or available to you on request.
Student or You means you or any person using the Studio facilities as your guest or in your care.
Studio means the studio premises of Tidal Yoga, 115 Leith Walk, Edinburgh EH6 8PN and or any such venue as We may from time to time run our Activities from including all of the physical spaces that are occupied including our yoga studio, change area, entrance, facilities.
Terms or Terms and Conditions are as defined here.
Website means www.tidalyoga.com or affiliated websites.
We and Us means Tidal Yoga Ltd a private limited company registered with Companies House (number SC808888), registered office 115 Leith Walk, Edinburgh EH6 8PN trading as Tidal Yoga.
3. Consent Forms
If You are a new client, You may be required to fill out a consent form and You will be required to sign a liability disclaimer before participating in Your activity. This will be by ticking that you have read the terms and conditions before taking part in an activity and on purchase of a class session or class pack.
4. Teaching schedule
We reserve the right to modify our class/activity schedules and opening hours in our absolute discretion. Where a class/activity is withdrawn, cancelled, or rescheduled, We will make efforts to notify You and offer an alternative. If that is not possible then a refund will be issued.
Our classes are all subject to availability.
When necessary we will arrange a substitute teacher with as much advanced warning as possible and this information will be available on the website (if time allows).
We recommend arriving at the studio 10 minutes before your class/activity begins. Less than 5 minutes and your place in the class will be offered to waiting students or drop-in students. It is necessary to check in on arrival. For health and safety reasons We need to know that You have arrived at the Studio and so it is a strict condition that You check in with reception/teacher before the start of any activity.
Due to the layout of the studio the main door will be locked once a class begins. No late comers will be admitted once the door is locked at the start of a class and no refunds issued.
5. Clothing
Students should dress for Activity, loose trousers, shorts or leggings and remove footwear before participating in the class/activity (yoga socks can be worn for an active class or normal socks in a restorative class) unless directed otherwise by an instructor, subject to these Terms, or as medically advised by a Your medical practitioner.
6. Fitness and Health
6.1 We shall support your experience with Us by instructing you in the Activity which We are qualified to give. We are not qualified to express an opinion that You are fit and can participate in the activity safely.
If you are unsure please seek advice from a medical professional.
6.2 You are responsible for monitoring your own condition during any Activity. Please stop and inform the instructor if you suffer any unusual symptoms.
6.3 Please ensure that you inform the Studio Manager or Instructor prior to attending any Activity of anything relevant regarding your physical condition including and not limited to pregnancy.
6.4 By attending an Activity, You state that you are physically fit and have no medical condition which would prevent you from taking part.
6.5 We may refuse access or provision of our services if, in discretion, We consider that your health or that of any other Student may be endangered by participating in any Activity.
6.6 You must not take part in an Activity if you are under the influence of alcohol or non-prescription drugs.
6.7. We prefer that you do not participate in any Activity if you feel unwell, are displaying flu like symptoms of or those of Coronavirus.
7. Personal Belongings and Lockers
7.1 All personal belongings brought into the Studio are at the owner’s own risk. We do not accept legal responsibility for any loss or damage to such items. We do not accept any liability for loss or damage to such items or any responsibility for items left on the premises.
7.2 If you leave belongings in the Studio, We have the right to remove your belongings. We will store removed belongings for up to 2 weeks after which we may remove them and after this time, will in our discretion, give items to charity.
7.3 Mobile phones, smart watches and any other electronic devices should be left in the changing room/lockers and silenced or turned off during your visit to the Studio. NO electronic devices are allowed in the Studio.
7.4 Photos – you may take photos of yourself in the Studio before or after an Activity but it is prohibited to take photos or film other students in the Studio or changing area.
7.5 We may request to take photos or film students during an Activity, We will always ask permission of all participants and ensure only those giving consent are captured in images/videos.
8. Cancellation and Refunds
Cancellation policies
Weekly classes – with membership please ensure you cancel your place in a class as early as possible to allow another person to take the space.
Weekly classes – without membership cancellation with more than 8 hours notice you can transfer the credit to another class. Less than 8 hours notice and no refund or credit is given.
Workshops and other events/activities (excluding weekly classes)
More than 7 days notice a full refund will be issued or studio credit given
7 days to 3 days (72 hours) 50% refund or credit
Less than 72 hours no credit or refund
Monthly memberships
By signing up to the monthly membership, You agree that the membership allows, subject to availability, unlimited access to full price weekly studio peak or off peak, excluding workshops and events, activities.
The membership is personal to the person for whom the membership is bought for and is non-transferable and cannot be used by another.
The memberships begin on the day of purchase and will be renewed automatically on that date each month on a rolling basis until it is cancelled by you by email. The first payment is taken on the day of purchase and renewal payments are taken automatically on the renewal date every month using the stored bank card details provided at time of purchase.
If renewal payment fails due to card expiry, cancelled card or for any other reason, you are still liable to pay the amount owed using an alternative payment method.
Monthly memberships require a minimum of 3 month commitment, after that time you may choose to cancel the membership anytime providing You give at least 30 days notice before next renewal/payment due date. Notice must be given via email to alex@tidal.yoga and We will confirm receipt of such notice by email. Verbal notice cannot be given to cancel membership. If the above notice is not given , the monthly payment will be taken and You will not be eligible for any refund.
We reserve the right to cancel this membership at any time by giving a minimum of 14 days notice a cancellation will take place on the next payment date following the expiry of the period of notice.
We may need to increase the price of monthly membership or to change the T’s&C’s. If this is necessary we will give at least 21 days notice before such changes take effect. If You do not wish to carry on membership under the new price structure you will have the 14 days time period to cancel/terminate your payment. If you do not cancel then the new payment will be taken in accordance with that notice.
9. Gift cards
STRICTLY valid for 6 months from date of purchase.
10. Pricing Information
Prices and fees are clearly presented on the website and we reserve the right to vary or increase fees from time to time.
11. Safety and Hygiene
11.1 We do not allow glass or crockery in the Studio unless We have organised this.
11.2 Animals are not permitted in the Studio unless assistance dogs and with prior arrangement.
11.3 Smoking or vaping are not allowed in any part of the Studio
11.4 Pay attention to signage relating to health and safety at the Studio. Fire Exit is clearly marked and in the event of a fire you should make your way out of the Studio through the Fire Exit as quickly as possible.
11.5 If you suffer an injury on the premises you must report it and the circumstances under which it happened to the teacher or manager on duty immediately.
11.6 You must follow the reasonable safety direction of the instructor during any Activity.
12. Student Conduct
12.1 You must NOT arrive at the Studio and attempt to take part in any Activity under the influence of alcohol or drugs.
12.2 We will show appropriate respect to You and expect You to behave respectfully and politely to Us and all other people in the Studio and taking part in Activities. If your behaviour is intolerable, upsetting or abusive we have the right to ask you to leave the premises.
13. Children
13.1 Children are not permitted in the Studio to participate in an Activity unless it has been agreed in advance.
13.2. Babies will be permitted with a parent during a Mother & Baby yoga class only.
14. Jurisdiction and Third Party Rights
14.1 We shall try to resolve any disputes with You quickly. Our T’s & C’s shall be governed by the laws of Scotland and subject to the exclusive jurisdiction of the Scottish courts.
14.2 In the event of a dispute between us, You and We agree not to engage in any conduct or communications including on social media, designed to disparage each other or any member of our team.
14.3 No one other than a party to these T’s & C’s has any right to enforce any term of our contract or to use any of the facilities that We offer.
15. Limitation of Liability
15.1 Except for any legal responsibility that We cannot exclude in law (such as death or personal injury caused by negligence) We are not legally responsible for any losses that (a) were not foreseeable by You and Us when our contractual obligations were formed and (b) that were not caused by any material breach of the Terms on our part. We are also not responsible for any business losses, including loss of business, loss of profits, loss of management time and loss of business opportunity.
15.2 Our total liability to You is limited to the amount of fees that You have paid for relevant Activity, membership or to Us.
15.3 Neither party shall be in breach of this agreement or otherwise liable for any failure or delay in performance of its obligations if such delay or failure results from events, circumstances or causes beyond its reasonable control. The time for performance of such obligations shall be extended accordingly. If the period of delay or non-performance continues for 3 months, the party not affected may terminate this agreement by giving 7 days written notice to the affected party.
16. Your information and data protection
16.1 Your personal information that You provide Us with will be dealt with in line with our Private Policy which you can access from the Studio and/or website on request. If you want to know what information We hold about You, or You want us to correct any information We hold about You, the appropriate procedures are set out in our Privacy Policy.
17. Billing
17.1 We use a third-party payment processor to bill You through a payment account linked to your website account for paid services. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to these Terms of Service. More information is available in our Privacy Policy. We are not responsible for errors by the Payment Processor, all charges at the prices then in effect for nay use of such Paid Services in accordance with the applicable payment terms and You authorise us, through the Payment Processor, all charges at the prices then in effect for ay use of such Paid Services in accordance with the applicable payment terms and You authorise us, through the payment processor to charge your chosen payment provider. You agree to make payments using that selected Payment method. We reserve the right to correct any errors or mistakes that the Payment processor makes even if it has already requested or received payment.
18. General Guidelines
18.1 You must observe the Studio guidelines which may be notified to You from time to time and are requested to comply with any reasonable directions or instructions which We may issue for the smooth operation of the Studio.
18.2 You should give written/email notice of any change of address or contact details. Should you fail to do so, all communications that We send to You will be deemed to have been received by You were sent to your last know address or email address.
